Whether a potentially key piece of evidence can be used in the case against Oral 'Nick' Hillary is now up to a judge.
Hillary is set to stand trial in September for the strangulation death of 12-year-old Garrett Phillips.
The prosecution in the mater is pushing to have complex testing that it says indicates Hilary's DNA was found underneath Phillips' fingernails admitted into court. The defense, however, argued that the testing is inaccurate and that it doesn't point to Hillary being the killer.
After listening to both sides Monday, the judge is expected to make a written ruling soon.
