The man accused of killing his wife and a responding State Police Trooper this past summer was back in court Wednesday.
Justin Walters, a Fort Drum soldier, appeared before a judge as the defense and prosecution argued about whether statements he made could be used in a potential trial.
Police say that last August, Walters shot and killed his wife before then fatally shooting Trooper Joel Davis, who was the first person on scene at the home in Theresa.
According to 7 News, fellow Trooper Chris Wyant-also on scene that night--told a judge yesterday that Walters asked about Trooper Davis. When told Davis was dead, Walters allegedly said, "you're just trying to scare me."
If a plea isn't worked out, Walters could go to trial as early as this fall.
